1.
Please read these terms and conditions carefully before
completing and returning our booking form. Once a completed booking form
has been accepted in writing by Backwoods Survival School, all persons
named on the booking form (here-after to be known as “participant”)
will have entered into a binding contract on the basis of these terms
and conditions. If you have any questions regarding these conditions,
please do not hesitate to contact us. 2.
In all classes, demonstrations and excursions conducted by
Backwoods Survival School, reasonable care is taken to prevent serious
injury and to minimise accidents. A Backwoods Survival School course is
by its very nature, exposed to natural variables, including the weather.
Whilst every reasonable effort is made to deal with (indeed to learn
from) such contingencies there may be occasions when Backwoods Survival
School, through no fault of its own, is forced to vary or modify a
course itinerary at short notice or decides to do so in order to take
advantage of natural circumstances. The participant acknowledges this
information and that in such circumstances it is not reasonable for
Backwoods Survival School to be liable for any losses consequential on
such a change and that Backwoods Survival School liability is limited
accordingly. 3.
Backwoods Survival School states that woodlands and other
habitats may present risks to Health and Safety and it is the
responsibility of Backwoods Survival School to alert the participant to
these risks. Whilst it is impossible to list all such hazards and risks.
Backwoods Survival School have completed a risk assessment (available on
request) covering those areas, which in the opinion of Backwoods
Survival School require the most specific care and attention. No
unauthorised
fires are allowed without the express permission of Backwoods Survival
School. Even if authorised
by Backwoods Survival School, no fire shall be left unattended at any
time and adequate means of fire fighting must be provided and available
at the site of any such fire at all times. The
participant should be advised that axes, bill-hooks and the like are
very sharp and are not to be touched or moved without the express
permission of Backwoods Survival School, especially by children,
Parents/carers/guardians
should make their children under their charge fully aware of the risks
involved with the above. Backwoods
Survival School also insists only knives which are lockable may be used
by the participant. All other knives are not to be used whilst under
instruction of Backwoods Survival School, under instruction shall be
deemed from the start time and the end time of a course run by Backwoods
Survival School and as detailed by Backwoods Survival School in the
course joining instructions. 4.
The participant states that he/she is fully aware that survival
courses; team building and wilderness living skills courses, even under
the safest conditions possible, may involve an element of risk. Whilst
Backwoods Survival School will take every precaution possible to ensure
a safe environment as is reasonably possible, the participant hereby
agrees to accept full responsibility and assume all risks, including
those caused by acts of God, of injury, death and/or loss to his/her
person and/or property, knowingly and voluntarily. 5.
The participant agrees to obey the rules and regulations put into
effect to minimise
risk to Health and Safety by Backwoods Survival School. 6.
Backwoods Survival School reserves the right to remove any
participant from a course, at the discretion of Backwoods Survival
School, if the participant conduct is abusive or inappropriate or they
continue to present a risk to Health and Safety. 7.
The participant knowingly, voluntarily and irrevocably waives any
and all past, present and/or future claims, demands and courses of
action which the participant now has or may have in the future against
all officers, employees, agents, instructors, and/or other participants
while on the premises of Backwoods Survival School or premises used by
Backwoods Survival School for the purposes of instruction, for any and
all past, present, and/or future injuries, death, loss including those
caused by acts of God, received while participating in activities
conducted by Backwoods Survival School, as a student, participant,
spectator, and/or visitor, or in any other manner or form, taking part
in the exercises, practices excursions, and/or demonstrations of said
survival courses, team building and wilderness living skills training. 8.
The participant certifies that he/she is physically capable to
participate in courses run by Backwoods Survival School despite the rigors
and risks that may be inherent in such an undertaking. 9.
Backwoods Survival School reserves the right to alter dates
and/or location of courses, if this becomes necessary, Backwoods
Survival School will endeavour to inform relevant parties as soon as possible. 10.
The participant accepts that the balance of all fees must be paid
3 weeks prior to any course commencement date. Bookings made within this
period must be accompanied by payment in full, unless otherwise agreed
by Backwoods Survival School in writing. 11.
If full payment is not made Backwoods Survival School reserves
the right to treat the agreement as cancelled by participant pursuant to
clause 10. 12.
The sum of the deposit is
either £25 per person for a one-day course, £40 per person for a 3-day
course and £100 per person for more than 4 days. The participant is
aware that cancellation by the participant, for any reason, will incur
the forfeit of the deposit. The deposit can be reallocated to another
course one time only if the cancellation is made 3 weeks prior to the
course for which it was originally intended. The participant
acknowledges that it is reasonable for such penalties to arise, given
the need for Backwoods Survival School to make preparations for the
course substantially in advance of any survival courses and/or team
building and/or wilderness living skills training. 13.
Whilst every effort is made to limit prices to those given in the
booking form and or other documentation, Backwoods Survival School
reserves the right to alter prices should costs in hosting a course
increase for reasons beyond its reasonable control (including, without
limitation, the cost of labour, transport and materials). In the event that a price is
altered the participant will be notified as soon as reasonably possible
and the balance of the altered price will be payable on the same terms
as was the original price. In the event of a price increase the
participant may opt to cancel the booking and will then be entitled to a
full refund of all monies paid to Backwoods Survival School. 14.
In the unlikely event that a participant has cause for complaint,
Backwoods Survival School would appreciate that it is brought to the
attention of a Backwoods Survival School representative during the
course, in order that corrective action can be taken. However, should a
problem not be resolved, a complaint should be made in writing within 28
days of the course completion. To the extent permitted by law Backwoods
Survival School will not be liable in respect of claims first intimated
later than 28 days from the close of the relevant course. 15.
Subsequent instruction by participant. Although Backwoods
Survival School courses are taught by experienced and capable leaders,
it is not intended that any instruction provided to any participant
while on a course will in any way qualify that participant to instruct
any third party and no warranty is made to that effect. Backwoods
Survival School hereby excludes any liability it might have to any third
parties in respect of any loss or damage suffered or incurred by a third
party in its reliance on any skills taught by any participant on the
basis of having attended any Backwoods Survival School course. 16.
The person signing the booking form shall be deemed to sign that
form for him/herself and as an agent for all others persons/parties
listed on that form and warrants that he/she is appointed agent for that
purpose. 17.
Acceptance of these terms and conditions, by completion of the
booking form, signifies acceptance of the participant that any
photographs taken during courses by Backwoods Survival School
instructors may be published on behalf of or included in printed or
digital promotional material for Backwoods Survival School. |
